Court-wide rules

Applies court-wide

Siskiyou Superior Court publishes its filing requirements at the court level rather than per judge, so these 439 rules are what govern this courtroom.

Filing Requirements

All 216

    Judgment

Parties are encouraged, but not required, to include the specified incorporation and compliance language on the face of the judgment.

  • Applies to
    Proposed judgment

The moving party must submit the original and two copies of Form FL-190 with the proposed judgment and required forms, and the petitioner must submit two prepaid first-class envelopes addressed as shown on the notice.

  • Applies to
    Interpreter request

A party needing an interpreter for a hearing may request one, either personally (if unrepresented) or through counsel, by using Judicial Council Form INT-300.

Service

All 90
  • The citation must be served on the persons and in the manner specified by Family Code §7880.

  • When an alleged natural father is claimed to be unidentifiable or unlocatable for service, the petitioner must serve notice of the proceedings under Family Code §§7666 and 7667.

  • Applies to
    Motion

All motions, including motions for relief from default, must be filed with the Court clerk and include proper proof of service.

Filing Timing

All 54
  • A Family Law Facilitator complaint or objection must be filed within 60 days of the last event leading to it.

  • Upon filing a stepparent adoption petition, the Clerk must immediately notify the Child Custody Counselor.

  • Opposition papers must be served and filed within seven (7) days after the filing of the motion.

Adjournments

All 21
  • The party who requested an official court reporter must notify the court manager and reporter’s office at least 24 hours before a proceeding that is settled, continued, or otherwise will not proceed as calendared.

  • Ex parte applications for extensions of time must be submitted to the Court clerk, who presents them to the presiding Appellate Division judge for review.

  • The Court generally grants an agreed continuance when all counsel and self-represented parties agree on the new date and time, provided the reporting party gives the required notice at least two court days before the hearing and files written confirmation before the hearing.
