Applies court-wide

Circuit Court of Jasper County, Illinois (4th Judicial Circuit) publishes its filing requirements at the court level rather than per judge, so these 114 rules are what govern this courtroom.

Filing Requirements

All 63

    Notice of hearing

A motion-hearing notice must identify the motion judge, action title and number, presentation date and time, and nature of the motion.

  • Applies to
    Complaint or petition

When seeking the specified ex parte orders, the complaint or petition must be filed with the Clerk before applying to a Judge, if the Clerk’s office is open.

  • Applies to
    Notice of hearing

After a motion is heard without prior notice, the attorney obtaining the order must serve written notice containing the specified case, judge, hearing, and order information on parties not found in default, and file proof of service within two days after the hearing.

Service

All 27

  • Notice that additional relief has been sought must be given in accordance with Supreme Court Rule 11.

Filing Timing

All 12
  • The moving party must call a filed motion for hearing; if it is not called within 90 days of filing, the court may strike it or set it for hearing.

  • Such cases shall not be redocketed if a motion to reinstate is not filed within thirty (30) days from the date of said notice.

  • When required, a Financial Affidavit must be filed by the earlier of the proposed-parenting-plan deadline under 750 ILCS 5/602.10 or at least five days before a contested-issues hearing, unless otherwise ordered; no additional affidavit is needed for a permanent-relief hearing after a temporary-relief filing unless its contents have substantially changed.
