Court-wide rules

Applies court-wide

Calloway Circuit Court publishes its filing requirements at the court level rather than per judge, so these 190 rules are what govern this courtroom.

Filing Requirements

All 75
  • Applies to
    Adoption records inspection request

An application to inspect adoption records must be filed with the Circuit Clerk's Office, which then transmits the request and applicable file to the Family Court Judge.

  • Applies to
    Protective order petition

Protective-order petitions must be accepted and filed with the court.

  • Applies to
    Motion for compensation

A motion for compensation must include an affidavit stating the hours and description of services, the reasonableness of the requested fee, and the conclusion and disposition date of the action or proceeding.

Filing Timing

All 40
  • Applies to
    Motion

Motions for a Wednesday motion hour must be filed with the appropriate clerk by close of business the preceding Wednesday, unless the Family Court Judge approves otherwise.

  • Applies to
    Motion

If a case is added to the motion hour docket due to a motion that is timely filed pursuant to the previous paragraph, subsequent motions filed after the deadline shall be accepted as filed and may be heard along with the timely filed motion.

  • Applies to
    Motion

If the case is not already on the docket, a motion filed after the deadline will be rejected and returned so it can be re-noticed for a compliant date.

Service

All 23
  • Applies to
    Response

Any response to a motion must be served at least two days before the motion-hour date.

  • Photocopies of motions and notices must be delivered to opposing parties or counsel on the filing date by mail, hand delivery, fax, or another court-approved method.

  • Applies to
    Motion
    Service
    Personal service

In a Family Court case where a motion is filed six months or more after the decree or final or last order, personal service under the Kentucky Rules of Civil Procedure is required, and service on prior counsel does not suffice.
