Court-wide rules

Applies court-wide

Campbell Circuit Court publishes its filing requirements at the court level rather than per judge, so these 339 rules are what govern this courtroom.

Filing Requirements

All 170
  • Applies to
    Petition

The reviewing judge must identify in the petition’s Court Action section which type of protective-order action resulted.

  • Applies to
    Written court authorization

Neither party may call a child as a witness or bring the child to Court without prior written Court authorization.

  • Applies to
    Child support order or agreement

A child-support worksheet must be attached to every order or agreement for child support ordered by the Court or agreed to by the parties in a case before the Court.

Filing Timing

All 56
  • The court must review a protective-order petition immediately upon filing.

  • Petitioners must not be sent away or left waiting for extended periods.

  • Petitions should be reviewed within an hour of presentation to a judge or trial commissioner, unless none is available.

Service

All 30
  • If a Temporary Removal Hearing is set within 24 hours after entry of an Emergency Custody Order, the clerk must notify all relevant parties and attorneys that the order was entered.

  • When time is of the essence, faxed or electronic copies of Emergency Custody Orders or petitions are sufficient notice to the listed recipients.

  • Applies to
    Summons

When a case is transferred because of a pending dissolution or custody matter, the initiating court must reissue the summons if service has not been made, for up to fourteen days or as the court deems necessary for the petitioner's protection; later reissuance is handled by the transferee court as needed.

Communication

All 26
  • After-hours petitions must be brought to the on-call judge for consideration.

  • Contact
    Phone

If the District Court Judges and/or Family Court Judge are unavailable, the Clerk should call a non-Family Court Circuit Judge.

  • Final hearing and, if applicable, Case Management Conference dates must be obtained by contacting the Court's Staff Attorney.
