Court-wide rules

Applies court-wide

Crittenden Circuit Court publishes its filing requirements at the court level rather than per judge, so these 164 rules are what govern this courtroom.

Filing Requirements

All 82
  • Applies to
    Motion for compensation

A motion for compensation must include an affidavit stating the appointment’s statutory basis, the hours and description of services and reasonableness of the requested fee, and that the proceeding concluded and its disposition date.

  • Applies to
    Motion and notice
    Must include
    certificate of service

Each motion and notice must include a certificate of service identifying the recipient, delivery method, and date of delivery or transmission.

  • Applies to
    Motion

Motions served on the adverse party must state a hearing date, except motions included in an answer; a motion without a hearing date is treated as not filed.

Communication

All 19
  • Dates and times for a telephonic conference may be obtained through the Judge’s Case Managers at the Office of the Family Court.

  • Parties are responsible for keeping the Court informed of address changes.

  • During the hours of 8:00 A.M. to 4:00 P.M. Monday through Friday, a person who wishes to obtain an Emergency Protective Order should go to the Circuit Clerk's Office in their respective county and file a Domestic Violence Petition.

Service

All 17
  • After the hearing, the Petitioner must continue diligent efforts to locate and notify every person who was not served.

  • Applies to
    Response

Responses, if any, must be served at least 2 days before the hearing; the court may waive this time limit for good cause or in the interest of justice.

  • Photocopies of motions and notices must be sent to opposing parties or counsel by mail, hand delivery, fax, or another court-approved method; the excerpt begins a same-date requirement but cuts off after “the motion or.”

Filing Timing

All 15
  • The time frames for filing a Notice of Appeal or a motion to reconsider run from entry of the original order with the Circuit Court Clerk.

  • Applies to
    Motion

Motions must be filed at least 7 days before the scheduled hearing; late motions may be denied or continued, subject to the stated exceptions and the court’s authority to waive the time limits for good cause or in the interest of justice.

  • If the court closes for an unforeseen reason, the party who filed the motion must re-notice it for a regularly scheduled Motion Hour.
