Kenton Circuit Court Filing Rules

A jury-case trial brief must outline the issues, points relied upon, authorities, and other matters that may assist the Court in trying the case.

An original Request for Admission may be filed after the response time and any CR 6.05 extension have expired, provided it contains proof stating the precise service date and manner.

A criminal motion must be scheduled for a definite time with the assigned Division Judge.

Once a hearing is assigned, the requesting attorney must send a Notice of Hearing to the opposing party or counsel.

Unless otherwise ordered or directed by the Court, joint exhibits must use the JX prefix and be numbered sequentially.

If a party’s counsel is unable to proceed, the Chairperson may continue the case.

A commissioner hearing fee is charged at $40 per hour, assessed in $10 increments for each quarter hour or part thereof, and is payable through the circuit court clerk to the commissioner by the fifth working day after the hearing concludes.

Counsel must make a good-faith effort to resolve discovery disputes before filing a motion to compel discovery, for a protective order, or for sanctions.

Privileged or confidential information filed with the Court must be placed in a sealed envelope marked “Confidential/Privileged.”

A courtesy copy of each motion must be delivered to the Court.

Legal briefs and memoranda must be filed of record in accordance with Kentucky’s electronic-filing rules or successor documents.
