Court-wide rules

Applies court-wide

Oldham Circuit Court publishes its filing requirements at the court level rather than per judge, so these 225 rules are what govern this courtroom.

Filing Requirements

All 106
  • Applies to
    Entry of appearance

Upon being retained, counsel must file a written entry of appearance unless the appearance is apparent from filed pleadings.

  • Applies to
    Pleadings and entry of appearance

Counsel must provide specified office and contact information on the pleadings and in the entry of appearance.

  • Counsel seeking withdrawal generally must obtain relief by written motion and notice, but the Court may permit an oral motion for good cause if the litigant's interests are not adversely affected.

Filing Timing

All 42
  • Mailed or emailed motions are not recognized until the original is received and filed by the appropriate Circuit Clerk.

  • The parties must follow the deadlines in the Order Scheduling Jury Trial.

  • Motions may not be filed on the morning of trial unless the Court grants leave.

Service

All 27
  • A motion to withdraw must be served on the client.

  • Unless the parties agree, a motion to change bond conditions must include appropriate notice to the Commonwealth.

  • Service
    Electronic service to opposing party

Unless the Court directs otherwise, requests to docket a case and notices of motions must be electronically served on opposing counsel at least 7 days before the Motion Docket.

Communication

All 19
  • Unless otherwise specified, counsel must meet in chambers at 8:00 a.m. to discuss preliminary matters, motions, and jury instructions.

  • If a case settles, the parties must notify the Court and Circuit Clerk by 1:00 p.m. two business days before trial, unless the Court waives that notice requirement upon notice and good cause; the Court may refuse a plea agreement if a jury has reported.

  • The criminal docket is conducted in person, and parties and counsel may not appear by teleconference or video conference without leave of court; incarcerated defendants and defendants receiving inpatient treatment are excepted from the in-person docket requirement.
