Court-wide rules

Applies court-wide

Second Judicial District Court, Nebraska publishes its filing requirements at the court level rather than per judge, so these 81 rules are what govern this courtroom.

Filing Requirements

All 28
  • Applies to
    Proof of parenting course completion

The moving party must submit proof of parenting-course completion before a temporary-orders hearing is scheduled, unless there is an emergency.

  • Applies to
    Adoption application

An application for an adoption-consent order must include a photocopy or duplicate original of all relinquishments and consents required by law.

  • Applies to
    Adoption consent

Attorneys are advised that substitute consents are required when a natural parent cannot consent, including in cases of abandonment.

Service

All 13
  • The petitioner must prepare a property statement within 60 days of service and furnish a copy to the opposing party.

  • The responding party must add any additional property and value estimates to the statement and serve those additions on the initiating party within 30 days after the initial statement is filed.

  • Applies to
    Property statement

Property statements must not be filed with the court, but proof of their service must be filed.

Communication

All 8
  • The parties must notify the court if a temporary hearing is expected to exceed 15 minutes; it will then receive a special setting beyond the otherwise stated 14-day period.

  • Attorneys may contact the County Court to ask the Clerk Magistrate to add them to or remove them from the court-appointed list.

  • Ex parte communication with the court is prohibited unless all interested parties expressly permit it.

Adjournments

All 7
  • A party may receive an extension to file or complete a property statement by written motion upon a showing of good cause.

  • The continuance motion form asks the filer to state the original date, reasons for the request, the other party’s position, and a proposed rescheduled date.

  • If the opposing party objects, or reasonable efforts to contact the party are unsuccessful, the moving party must set the continuance motion for hearing.
