Tenth Judicial District Court, Nebraska Filing Rules

A completed Department of Health Bureau of Vital Statistics form must be filed in each dissolution or annulment action, and a decree will not be entered unless it is complete.

If the voluntary appearance lacks a brochure receipt, the district court clerk must mail the brochure to the defendant.

If responsive affidavits are required, the court must receive them within three business days after the hearing.

Affidavits offered by pro se parties must comply with Rule 10-4(A).

Defense counsel must notify the district court clerk 10 days before a hearing if an interpreter is needed for the defendant or a defense witness.

If the opposing party objects to a continuance, the movant must set the motion for hearing.

Except in criminal cases and proceedings with a court-approved poverty affidavit, court costs must be paid when an action is commenced and when liability for additional costs accrues.

Opposing counsel may respond for the time the court authorizes at the hearing.

Court-filed documents and trial exhibits must not contain complete financial account or debt numbers; the numbers must be redacted as needed, while still being identifiable by agreement or court direction.

The court will consider no more than 20 affidavit pages, excluding exhibits, absent prior court approval.

Affidavits must not be filed electronically.

Less experienced attorneys should receive cases within their capabilities and the opportunity to expand their experience under supervision.
