Court-wide rules

Applies court-wide

Court of Common Pleas of Cumberland County, Pennsylvania publishes its filing requirements at the court level rather than per judge, so these 434 rules are what govern this courtroom.

Filing Requirements

All 172
  • Applies to
    Motion

A motion must prominently identify the responsible attorney and email address, and identify both attorneys if someone else submits the papers.

  • Applies to
    Motion

A motion must state whether a judge has ruled on another issue in the same or a related matter and, if so, identify the judge and issue.

  • Applies to
    Motion

A motion must include a brief statement of the applicable authority.

Filing Timing

All 82
  • The Discovery Report and Recommendation must be filed with the Clerk following an agreement or hearing.

  • The objecting party must file its brief with the Prothonotary at the same time as the preliminary objections; an untimely brief may alone support denial of relief.

  • The responding party must file its brief within 30 days after service of the objecting party’s brief and comply with the requirements of subsections (a)(1)–(4).

Service

All 65
  • The discovery hearing officer must notify all parties in interest of the hearing at least 20 days beforehand.

  • The objecting party must immediately serve its brief on opposing counsel and any unrepresented party and file an affidavit of service.

  • The responding party must serve its brief within 30 days after service of the objecting party’s brief.

Formatting

All 30
  • The electronic copy submitted to the Legislative Reference Bureau must be in Microsoft Word format only.

  • Briefs must cite reproduced-record material by page and line and identify unreproduced material by the relevant part of the original record.

  • The proponent must photograph non-documentary exhibits, convert them to letter-sized documents, appropriately mark them, and produce them during the proceeding for the documentary record.
