Applies court-wide

Potter County Courts at Law publishes its filing requirements at the court level rather than per judge, so these 72 rules are what govern this courtroom.

Filing Requirements

    Pleading or motion
    Must include
    ai disclosure

Pleadings and motions filed by counsel or self-represented parties must comply with the AI standing order and contain the required AI certification.

  • Applies to
    Vacation letter
    Must include
    caption, case number

An attorney may reserve up to four vacation weeks per calendar year by sending a vacation letter for each case, identifying its cause number and style, to the court coordinator and opposing counsel.

  • Applies to
    Hearing request motion
    Must include
    certificate of service

One way to request a hearing is to file a motion requesting the hearing and an order setting it, accompanied by a certificate of service to opposing counsel.

Filing Timing

All 15
  • A party may request a virtual hearing, trial, or virtual participation by filing a written motion before the hearing’s announcement period.

  • Except for emergency orders or orders authorized by law for ex parte submission, proposed orders should be sent to opposing counsel for agreement as to form before being transmitted to the Court's queue.

  • No proposed order should be submitted to a court's queue unless specifically requested by the court.

Service

All 9
  • Applies to
    Objection

A party objecting to a virtual-hearing motion may file an objection and set it for hearing with proper notice to all parties.

  • Applies to
    Hearing setting confirmation letter

If a party asks the Court to schedule a hearing, the party must confirm the setting by letter and serve a copy on opposing counsel under Texas Rule of Civil Procedure 21a within three days of the setting.

  • Applies to
Temporary restraining order or ex parte application

Counsel presenting a TRO or other ex parte application must notify opposing counsel or an unrepresented opposing party and make a reasonable effort to provide them the application and proposed order at least two hours before presentation, except as provided in subsection (b).

Adjournments

All 6
  • If an attorney makes vacation plans after receiving a trial-setting notice, the attorney must immediately notify the Court and other parties and request a reset; the Court will rule after allowing all parties to respond.

  • Failure to comply with the hearing-setting rule may constitute good cause for a continuance.

  • A continuance motion based on an attorney's conflicting settings must be filed in every affected court and identify each conflicting case setting.
