Court-wide rules

Applies court-wide

Botetourt General District Court, Virginia publishes its filing requirements at the court level rather than per judge, so these 14 rules are what govern this courtroom.

Adjournments

All 6
  • The Clerk grants the first continuance in traffic cases.

  • The Judge grants the second continuance in traffic cases.

  • Continuances in criminal cases are coordinated by the Commonwealth's Attorney.

Filing Requirements

All 5
  • Applies to
    Modification request

A modification request may be submitted to the Clerk in writing during the agreement, must be made before any payment default, and may be granted based on need.

  • Applies to
    Community service documentation

Approved community service must be performed at a nonprofit, documented with the supervising authority's signature, and the documentation must be provided to the court unless a Court Community Corrections program serves the court.

  • Applies to
    DC-212

To receive credit for work performed while incarcerated, the defendant must fully complete DC-212 and submit it with supporting documentation of the work and rate of pay signed by the facility's supervisory authority.

Communication

All 3
  • A defendant requesting an extension to a deferred payment agreement must notify the Clerk in writing before the agreement's due date.

  • A community-service extension request must be made in writing and received by the Clerk before the completion due date.

  • If any part of a defendant's income comes from another source, the defendant must report the change to the Clerk's Office and then enter into a payment agreement.
