Benton and Franklin Counties Superior Court Filing Rules

Each party must sign and file the IFLT Selection Form at least 30 days before trial.

A dismissal order must be entered within 60 days of the earliest of the Notice of Settlement filing, scheduled hearing date, or written request for proof of settlement.

The arbitrator must set the hearing’s date, time, and place and provide reasonable written notice.

The email submitting the bench copy must state the speedy-trial expiration date, and the opposing party or counsel must provide its date if they disagree.

At the judicial officer’s discretion, failure to upload or provide bench copies could result in the matter being continued or stricken.

A motion to continue a summary judgment or partial summary judgment hearing, including one based on CR 56(f), must be scheduled for hearing at least one week before the scheduled summary judgment hearing.

A document prepared for a judicial officer’s signature must have at least two lines of text on its signature page.

Witness lists must be filed, served, and uploaded to eMotion at the same time and under the same deadlines as the Note for Docket and briefing.

The court will consider State requests to seal all or part of supporting affidavits or declarations and, if it grants a request, will enter an appropriate order.

Review of a Commissioner’s order is de novo on the pleadings and proceeds without oral argument unless the reviewing Judge requests it.

A party filing a Statement of Arbitrability must pay the required fee to the Clerk.

Absent prior authorization, the moving party is limited to 25 pages and the responding party to 20 pages per motion; specified documents are excluded from the count, and a request to exceed the limit must be made in writing at least one week before the merits hearing.

A Special Set request may not be joined with another motion, and additional time may not be added without court approval.
