Reason For Request

Court-wide rules

Applies court-wide

Lake Superior Court publishes its filing requirements at the court level rather than per judge, so these 220 rules are what govern this courtroom.

Filing Requirements

All 102
  • Applies to
    Pleading requesting a hearing

Pleadings requesting a hearing must leave the hearing time blank, state a preferred hearing date, and allow the court to assign the hearing time before filing; the court may contact the filer if the requested date is unavailable.

  • Applies to
    Case management conference statement

All parties must file the first case management conference statement on a Judicial Council-approved form; further statements are required only if ordered by the court.

  • Applies to
    Judgment or order

A judgment or order submitted to the court must be self-contained and may not incorporate by reference a document that is not physically part of it.

Service

All 40
  • An endorsed copy of the order must be served on the parties to be notified.

  • Unless otherwise ordered or provided by law, pretrial motions with memoranda, opposition papers, and reply papers must be served and filed under California Rules of Court §4.111.

  • Both parties must exchange formal authorized offers one week before the conference.

Filing Timing

All 39
  • Payment applications must be presented within 60 days after case disposition, and the court may reject later invoices.

  • All parties must file the case management conference statement no later than 15 days before the first case management conference.

  • Deadline
    4 court days

For uncontested proceedings, an original and one copy of the proposed judgment, decree, or order must be presented to the clerk at least four court days before the hearing, or the matter will not be placed on calendar.

Formatting

All 10
  • Motions in limine must be written and filed and served as early as possible, no later than the commencement of the trial assignment hearing.

  • Probate accounts for estates, guardianships, conservatorships, and testamentary trusts must conform to Probate Code sections 1061–1064 and, to the extent possible, use Judicial Council-approved forms.
