Court-wide rules

Applies court-wide

Clay Circuit Court publishes its filing requirements at the court level rather than per judge, so these 65 rules are what govern this courtroom.

Filing Requirements

All 28
  • Applies to
    Protective order petition

Protective-order petitions under KRS Chapters 403 or 456 must use form AOC-275.1 and be accepted and filed with the court.

  • Applies to
    Summons

If a case is reassigned or transferred, the issuing judge must re-issue a summons until the receiving judge can hear the matter.

  • Applies to
    Protective order petition

The reviewing judge must indicate in the petition’s Court Action section whether the resulting action is a domestic violence action or an interpersonal protective order action.

Filing Timing

All 14
  • The court must review a protective-order petition immediately upon filing.

  • Petitions should be reviewed within an hour of presentation to a judge or trial commissioner, unless none is available.

  • Clay County Division I matters must be filed of record and physically possessed by the Clerk by 4:00 p.m. on the Friday before the following Thursday motion hour to appear on the docket.

Service

All 9
  • Applies to
    Motion

Motions for Motion Day must be served by close of business on the fifth day before the Motion Day.

  • Applies to
    Notice and motion

On the day the notice of hearing is served, the attorney must deliver or mail a copy of the notice and motion to the clerk and judge.

  • Applies to
Notices and motions for motion day

Copies of Motion Day notices and motions must be served on the court when applicable to the case, with that service shown in the certificate of service; a noncompliant motion may be heard only at the court's discretion.

Communication

All 5
  • During regular business hours, the authorized agency or officer must present the petition first to the Family Court Judge, then follow the stated fallback order if that judge is unavailable.

  • After regular business hours, the authorized agency or officer must present the petition first to the Family Court Judge, then follow the stated fallback order if that judge is unavailable.

  • Petitioners seeking to initiate contempt proceedings should contact the Circuit Clerk’s office in the county of the court that issued the protective order.
