Responses, if any, must be served at least 2 days before the hearing; the court may waive this time limit for good cause or in the interest of justice.

If the court closes for an unforeseen reason, the party who filed the motion must re-notice it for a regularly scheduled Motion Hour.

Each motion and notice must include a certificate of service identifying the recipient, delivery method, and date of delivery or transmission.

Pleadings, motions, and documentation must be typewritten, except items of evidence.

E-filing is preferred, and represented parties should use the e-filing system for Family Court matters when possible.

A party unable to attend a scheduled motion hearing must immediately notify the moving party and try to agree on a new time; if unsuccessful, the party seeking a continuance must immediately file a written motion stating the reasons and send copies to Family Court and the Clerk. Dependency, neglect, or abuse matters must also comply with FCRPP 21; the Court retains discretion to grant or deny a continuance, allocate costs for good cause, or proceed despite party agreement.

When directed to prepare an order, an attorney or pro se party must mark it “Tendered By” or “Prepared By” and submit it to the opposing attorney or party for a “Have Seen” signature; that signature only confirms the order reflects the Court's findings and does not waive objections.

Each order must be prepared as a separate instrument.
