Dilatory plea

A hearing on special exceptions, pleas in abatement, or another dilatory plea must be obtained at least 30 days before trial or as soon as possible if filed within 30 days of trial; matters not heard are waived.

Any party filing special exceptions, pleas in abatement or other dilatory pleas shall request and obtain a hearing on them at least 30 days prior to the trial date or as soon as possible after the pleading is filed within 30 days of the trial date. Exhibits must be submitted to the Court Reporter by the 4:00 p.m. deadline on the day before the hearing.

If you intend to offer any exhibits during the hearing you need to email them to all parties and the Court Reporter (MABrantley@tarrantcountytx.gov) no later than 4:00 p.m. the day before the hearing.

A Robinson/Daubert motion must receive a hearing well before trial; failure to obtain a hearing date before trial waives the challenge.

It is important to note that a Robinson/Daubert motion must be heard well in advance of trial since the Court does not consider such motion during trial. Failure to obtain a hearing date on a Robinson/Daubert challenge before the start of trial is considered a waiver of such challenge

An application must be filed with the clerk and assigned to a court before it is presented to a judge, except when filing beforehand is impossible, in which case it must be filed as soon as possible afterward and the clerk must be notified of the judge’s actions.

No application for action or relief of any kind shall be presented to a judge until the application or case has been filed with the clerk and assigned to a court, unless it is impossible to do so. If it is impossible to file an application or case before it is presented to a judge, then it shall be filed as soon thereafter as possible, and the clerk notified of all actions taken by the judge.

If your motion, response, reply, and/or related exhibits combined are in excess of 50 pages, the party requesting a hearing must deliver to the Court by 12 p.m. the day before the hearing a binder containing all documents related to the hearing (e.g., both parties’ motions, responses, replies, exhibits, and attachments) appropriately tabbed with a table of contents. Failure to do so may result in cancellation of the hearing.
