Court-wide rules

Applies court-wide

Lewis County Superior Court publishes its filing requirements at the court level rather than per judge, so these 150 rules are what govern this courtroom.

Filing Requirements

All 57
  • Applies to
    Motion for revision

A motion for revision must identify each portion of the order for which revision is sought.

  • Applies to
    Transcript of commissioner oral ruling

The moving party must obtain the transcript at their expense and it must be prepared by an Official Court Reporter, except when the matter was decided by letter decision or no oral decision was rendered.

  • Applies to
Notice of issue or note for motion docket

A notice of issue or note for the motion docket must be filed and served with the motion and identify the motion, parties, attorneys if any, and argument date and time.

Filing Timing

All 42
  • A motion for revision must be noted so it is considered and determined within 30 days of filing; absent extraordinary circumstances, a motion not heard within that period is abandoned, stricken, and the commissioner’s ruling is affirmed.

  • A motion for revision must be filed with the Clerk of the Court within 10 days after entry of the order or judgment.

  • The revision form must designate a hearing date no later than 30 days after the motion is filed.

Service

All 17
  • Service
    Mail

Service by mail requires an additional three days’ notice.

  • Deadline
    5 court days

A copy of the motion for revision must be served on the other parties or their counsel within 10 days after entry of the order or judgment and at least five court days before the hearing.

  • A copy of the transcript must be served on the other parties at least four days before the hearing.

Formatting

All 10
  • Motion affidavits and declarations must be based on personal knowledge, contain admissible facts, establish the affiant’s or declarant’s competence, and exclude argument, comment, and nonexpert opinion.

  • Motions, responses, and replies must be written, typewritten or hand printed, on letter-size paper with numbered left margins, and double-spaced.

  • Handwritten cursive pleadings require an attached typed or hand-printed version, and the court will not consider a handwritten or cursive pleading without one.
