Complete rules summary for Judge Ivonne Cuesta

Notice of Hearing must be included as a supporting document in the COURTMAP hearing setting for the Remote 5-Minute Motion Calendar.

All attorneys and self-represented litigants must register for an account on the Florida Courts E-Filing Portal to file pleadings or motions with the clerk.

A pleading must be filed at the time of registration to activate an e-filing portal account, and self-represented litigants are recommended to file a Notice of Designation of Email as their first filing.

Parties must register for COURTMAP to submit proposed orders and schedule with the assigned judge.

Parties that settle must immediately file a signed and notarized MSA and/or Parenting Plan (if applicable).

Settling parties must submit a Proposed Final Judgment through CourtMap; unless these settlement steps are taken and the FJ is approved, all parties are expected to appear in court ready for trial.

Emergency motions and requests for hearing may be filed either with the Clerk of Courts or through the E-Filing Portal.

When filing through the E-Filing Portal, parties must add 11thFC01@jud11.flcourts.org to the e-service list.

The division e-service email address only accepts emails sent directly from the E-Filing Portal and rejects all other emails.

After an emergency motion is filed, it must be submitted via COURTMAP, and the Judge will determine whether it qualifies as an emergency.

For the Remote 5-Minute Motion Calendar, only one motion is permitted per case, so bundling multiple motions is prohibited.

The notice of hearing must be filed with the Clerk at least 7 business days before the hearing, and untimely notices will be rejected.

Motions with exhibits must be filed on the E-Filing Portal and must include 11thFC01@jud11.flcourts.org in all filings.

Parties must e-serve the opposing side with their filing through the E-Filing Portal.

Motion Calendar settings on COURTMAP require attaching the motion and any responses with an e-file stamp as supporting documents, and a party may set the hearing unilaterally if no date can be agreed upon.

All cases must attend mediation before trial.

Once the mediator's report has been filed, parties must file a Notice for Trial through the e-portal or with the clerk's office.

All proposed orders must be submitted via COURTMAP.

The opposing party must be included in all COURTMAP submissions.

COURTMAP is only for proposed-order submission; motions and other pleadings must not be filed through COURTMAP and must instead be filed via the E-Portal or in person at the Clerk's Office.

Every COURTMAP submission must include a cover letter.

The COURTMAP cover letter must state whether the matter has been heard, the hearing date (if heard), the title of the motion, that the proposed order was sent to the opposing party, and whether the opposing party agrees.

Proposed orders submitted without a cover letter indicating service on the opposing party are treated as ex parte communications and will not be read by the judge.

Proposed-order packages (for both heard and not-heard matters) must include a PDF cover letter, a PDF copy of the motion, and a WORD proposed order without preset templates or fillable forms, and orders that cannot be electronically signed will be rejected.

For heard matters, both parties must make every effort to submit one agreed proposed order conforming to the court's ruling, but may submit competing orders if they cannot agree.

For matters not previously heard, proposed orders will be accepted via e-courtesy only for the listed categories (motions to compel mandatory disclosure, motions to withdraw with client consent, motions for substitution of counsel, final judgments of paternity with supporting documents, and agreed orders).

Motions for continuance, default, and contempt will not be accepted via COURTMAP.

Proposed ex parte orders will be accepted only for properly filed ex-parte motions to compel discovery.

Printed courtesy copies submitted via mail will be rejected.

Parties must not mail copies of motions to chambers.
