An affirmative-claim expert designation must identify each expert’s name and business address and state the expected subject matter, facts and opinions, and grounds for each opinion when the expert is retained or specially employed.
Court's wording
Such designation must include the name and business address of each expert witness. In addition, the designation must state: --the subject matter on which each designated expert is expected to testify, and --the substance (i.e., the essential aspects and details) of both the facts and opinions to which the expert is expected to testify and, if retained or specially employed, a summary of the grounds for each opinion.
The Court requires that all expert disclosures be filed with the Court through the clerk’s office—not just the filing of a certificate of service demonstrating service of those disclosures.
Additionally, if the designating party herein intends to identify a treating physician as an “expert” and the witness will offer opinions outside of his/her own treatment (such as, for example, offering standard-of-care opinions, causation opinions, medical-bill opinions, or any other testimony/opinions that are derived from or based upon data outside of his/her own direct care), then the designation needs to include all information set forth above, as it relates to “retained or specially employed” experts.
Final witness and exhibit lists must be specific; catch-all descriptions are insufficient and will be stricken.
Court's wording
The final witness and exhibit list must be specific (catch-all phrases like any witness identified during the course of discovery or any and all documents produced in response to a request for production of documents is not sufficient and will be stricken).
The parties shall include a final list of witnesses and exhibits, in the Pre-Trial Order.
Such motion and any response thereto, must be in compliance with Kansas Supreme Court Rule 141, or it will not be considered.
Along with the designation of expert witnesses, counsel must provide at least two dates that each identified “retained or specially employed” expert is available to have his/her deposition taken within 30 days of the service of the expert designation.
Any such motion must recite, with particularity, the communications or attempted communications aimed at resolving the discovery dispute prior to the filing of the motion. The motion must also recite the date of the conference call referenced above.
A prepared report by a retained or specially employed expert must accompany the designation; the designation may incorporate the report if it contains the required information, otherwise it must state that information expressly.
Court's wording
In addition to the designation, if the expert witness is a “retained or specially employed” expert pursuant to K.S.A.60-226(b)(6)(B) and he/she has prepared a written report, such report must be provided along with the designation. If the written report contains the information contemplated by K.S.A. 60-226(b)(6)(A) &/or (B), the designation for that expert may simply refer to and incorporate the written report. If not, then the designation must expressly contain all required information, as described in the rule.

C. Any motions in limine.
A treating physician designated by a party with an affirmative claim must receive the retained-expert disclosures if the physician will offer opinions beyond the physician’s own treatment.
Court's wording

D. Any deposition designations.
A motion other than the listed exceptions must state counsel’s consultation attempts, their results, and whether opposing counsel agrees to the requested relief.
Court's wording
Any motion (other than a motion to dismiss, motion for judgment on the pleadings, motion for summary judgment or motion to compel) must contain a statement that counsel for the moving party has attempted to consult with opposing counsel, the result of those attempts, and whether or not opposing counsel agree(s) to the relief sought in the motion.
Parties may add agreed case-management terms, but must retain the form’s standard language and mark inapplicable sections in the deadline space.
Court's wording
NOTE TO PARTIES COMPLETING THIS FORM: You may add any additional case management terms and deadlines agreed upon by the parties. However, do not delete any standard language in the form. If sections are not applicable to your case, mark them as not applicable in the space provided for a deadline date.

Pre-Motion Conference Requirements
For a K.S.A. 60-237 Motion to Compel, counsel must arrange a Court conference call before the motion is set for hearing; the parties must email a dispute summary of less than one page at least 24 hours before the preliminary informal call.
If a Motion to Compel is filed pursuant to K.S.A. 60-237, counsel must schedule a conference call with the Court to discuss the motion before it will be scheduled for the motion hearing. Parties are required to forward a summary of the dispute of less than one page by email to the Division 11 Administrative Assistant at least 24 hours prior to the scheduled preliminary informal call. The Court will review the parties' good faith efforts to meet and confer under 60- 237 and will discuss the substantive issues with the parties-in advance of a formal hearing on the pending motion.
Page 8 | XV. Motions to Compel
Before filing a motion to compel, the parties or counsel must confer on the substance of the dispute; one letter, email, or phone call is not enough, and the moving party must certify a good-faith effort to resolve it.
Parties are reminded that K.S.A. 60-237 will be strictly applied. Motions to compel require the moving party to certify that they have made a good-faith effort to resolve the dispute by conferring or attempting to confer with the party who has not provided the discovery items. Sending one letter or email, or making one phone call, does not constitute the required effort, in the Court's view. The Court expects that the parties and/or Counsel will have spoken/met and conferred on the substance of the matter before the filing.
Page 8 | XV. Motions to Compel
The initial informal conference call required by Division 11 rules must occur before a hearing on a motion to compel is scheduled.
