Court-wide rules

Applies court-wide

Perry Circuit Court publishes its filing requirements at the court level rather than per judge, so these 108 rules are what govern this courtroom.

Filing Requirements

All 56
  • Applies to
    Motion

If the report is not filed within 60 days, the responsible agency or attorney must file a motion asking the Court to require an explanation for the delay.

  • Applies to
    Petition

A petition for a DVO or ex parte EPO must be verified.

  • Applies to
    Case data information sheet

A Case Data Information sheet (Form AOC-FC-3) must be filed with the petition.

Filing Timing

All 22
  • Exceptions must be filed and noticed, and a status hearing held, by the second regularly scheduled civil motion hour after the order is tendered by the Clerk.

  • Motions under PCFCR 201(A.) must be filed and clocked by 4:00 p.m. on the preceding Monday, and copies must be mailed, placed in the Clerk’s outside mailbox, or hand delivered by that time.

  • The Clerk will assign a motion to a docket only if both the motion and notice are filed by 4:00 p.m. on the preceding Monday before the hearing date.

Communication

All 7
  • The parties must contact the court's secretary to remove pending hearings concerning resolved issues.

  • During regular business hours, the authorized agency or officer shall present a petition to the Perry District Judge or District Court Trial Commissioner, or deliver it to the Perry Circuit Judge if neither is available.

  • After regular business hours, the authorized agency or officer shall present a petition to the Perry District Judge or District Court Trial Commissioner, or deliver it to the Perry Circuit Judge if neither is available.

Sealing

All 5
  • Parties must file one copy with personal data redacted and an unredacted copy in a marked, sealed envelope.

  • Access to the unredacted sealed copy containing personal identification is limited to the listed parties, attorneys, court personnel, and authorized Cabinet employees or agents; the source text ends mid-sentence.

  • When personal identifiers are required or included in covered filings, parties must file a redacted copy and an unredacted copy in a marked, sealed envelope, subject to the stated access restrictions and the exception for actions deemed confidential by statute.
